Legal Question in Family Law in Massachusetts

marriage

My husband was an illegal resident before I married him. We married and have a son he is 6. He also has a company that he established while being married to me. We have been married now for 7 yrs. We do not live together any longer but has taken residence with another woman being still married to me. My question is, Can he still become a perm. citizen? If I divorce him will he be sent back? this is his 2nd marriage.

If he is an illegal alien, then he has probably forged documents.

Whether he is sent back depends on DHS.

Re: marriage

If he became a legal resident, he remains a legal resident. His choice to move out does not change this, nor does his choice to live with another women. Deportation and refusal to naturalize are both fairly extreme, usually reserved for misconduct such as violence and other significant felonies. Sexual conduct with non-spouses is rarely (if ever) a grounds for this governmental remedy.
