Marriage Property Question - Vehicle Posession

I am currently seperated from my wife of 5 years and she has posession of a car that is titled to my name only, registered to me only, and insured by me only. What are my rights to the car? Can I use the police to return custody of the car to me? Am I the legal owner of the car?

Although the car is registered and titled to you only, it is likely considered as "marital property" if it was purchased while you were together during the marriage.

In light of your 5 year separation, it is advisable that you and your spouse set out the terms of your current living arrangement. Counsel can draft a property settlement agreement and have all titles, insurance and debts listed in your respective names.
