Massachusetts end of child support ?

In my original divorce aggreement it states that i will pay support until the youngest daughter reaches age of 23 .\

It also states that they must be in school FULL time

one girl attaind 23 4 15 08

I asked the court for a child support reduction.My Ex wife contested. i was ordered back to court a month later.with proof of wage.ect which i did ( i am paying at the 65% rate ) the Judge did not reduce my assignment and ordered we go to trial in 5 months

Question

i asked the school for a transcriptof enrollment .It states that one girl is 3/4 time and the 23 yr old is 1/2 time

as my contract states the girls must be in school full time. is this grounds to appeal the finding as a breach of contract, as emancipation is at 23 and the state has failed to follow the letter of the law

To add the 23 yr old hss a 3 yr old child (out of wedlock) and is collecting $142 a week CS

all live at home .

Father has medical issues and is expected to earn $16 000

Mother earns $52 000+ $174 wk support

Father non custodial and up to dat on support

If you have an attorney representing you in the pending case, which I presume is a Complaint for Modification, you should be presenting these questions to that attorney. If you are proceeding without an attorney, you should seriously consider retaining one.

If I am reading your question correctly, your case is still pending. the Judge may have found that no emergency existed to suspend payments on a temporary basis. However, the case is not over and you must go through with a trial where evidence can be presented in order for the judge to make a ruling as to whether a significant or substantial change in circumstance exists to allow the modification.
