modification agreement

My modification agr states that Emancipation is defined as:

attaining the age of 18 only if such child fails to continue with education as a full time student at an institution of higher learning.

& attaining the age of 23 regardless of whether or not said child has completed the college program or other edu prog he is enfolled. Based on that which one would apply-She turns 23 on July 1st her semester ends May 4 and she is going back in Sept Part time. Can I end the support on May 4 based on the fact that she is not going back full time?

Unless there is an automatic clause or an agreement between the parties, you need to file for modification. I believe the latter applies.
