my mom passed away and left me a small annuity. my husband just filed for divorce is he entitled to any of this? he has contributed nothing but a headache and a pit in my stomach to this marriage

In Massachusetts, all property of either spouse is subject to equitable division by the Court. Most likely, your husband will not be entitled to any portion of the annuity. However, your annuity will certainly be considered, along with many other factors, in determining how to divide the marital estate, whether and to what extent spouse support is appropriate, etc.
