Legal Question in Family Law in Massachusetts
money in house trust in divorce
one party is planning on moving into senior housing that takes a % of income towards rent. SS is all party has to live on. If house is sold and split, will the money from the sale count as assets and therefor be used in determining the rent?
Would it be better to sign the house over to one party and thensell...splitting the $$ after party moves to senior housing? If assets are considered what % will the housing take away. Amount of money here is roughly 150k each.

You need to engage an elder/disability law planning specialist for this issue. General discussion on the web cannot answer this question appropriately.
Re: money in house trust in divorce
If the housing is related to medicaid or mass health, then the party who moves into senior housing will have to use the $150,000 up before getting a reduced rent.
I would suggest you contact an elder law attorney and speak with someone who understands the terms of the housing matter you are asking about.
