what should one do if their mother kicked them out but does not want to give up her custidy rights and their only 16 years old?

You don't say what you want done or if this is the 16 year old. If custody is established by a divorce, the father can file a petition for physical custody. The child can seek independence by petitioning the court.
If there is no father, then the child should contact social services and seek help for her situation.
