Legal Question in Family Law in Massachusetts

motion of dismissal

My wife filed divorce in Oct. 07. We have a pre-trial hearing in April 08. I would like to reach final settlement as quickly as possible. I am afraid that she might not want to let it go easy. What if she requests to dismiss the case as a plantiff prior to the trial date? Anything I can do to keep the case open and continue the process instead of starting over by refiling?

Re: motion of dismissal

You can file a Answer asking for a Divorce or if she files a Motion to Dismiss, object to it.

If you do not have an attorney, I suggest you get one.

Ditto to Mr. Roth. Get an attorney to get it right.

: motion of dismissal

YOu could try mediation.

To avoid a dismissal, file an answer and counterclaim.
