Motion for temporary order

Hi , i have a court day coming real soon and i dont have an attorney but my husband does, i received a motion for temporary order from him and i dont agree with what he is asking for, what should i do?

If you don't have money for an attorney and this is a divorce case, you can ask the court to have your husband pay for your attorney or get an allowance from the marital property.

First, please note that there are attorneys who charge less, and attorneys who perform"pro bono" work. You should consider looking for such an attorney. I take clients on a sliding scale fee basis.

If you must handle this on your own, you should put in writing what you want as an order. The court will accept a less than perfect "pleading" from you.

You should also go to court prepared. To get your financial statement done, and you should do your best to calculate guidelines child support (if you have children and they will be with you). You can download a financial statement form from www.bcpfc.com. You can also get a guidelines calculation form from that website, I believe, but there is a more convenient calculator available from the Department of Revenue, Child Support Enforcement Division. To get this latter calculator, type into any search engine following: "DOR Guidelines MA child support calculator." I do not know the precise web address, because this is what I always do to get the calculator myself.

Consider retaining an attorney who may even be able to file a motion for an allowance from your husband to contribute to your attorney's fees to defend the action. Good Luck!

Get a lawyer, ask help from the lawyer of the day in Court, or simply state your opposition and the reasons.
