Are there any active court orders dealing with custody and visitation?

You will need either the Biological father's permission or the courts. Given the circumstances it should not be that difficult to accomplish.

First, we need to establish whether or not there is a current custody order in place. If there is not, you may be able to leave the Commonwealth without the father's permission and without the court's permission.
