Can I move out of state with minor children if parents were never married

The fact that you are married may or may not have bearing on the real issue - whether the other person's legal parentage has been established, and whether there are any current court orders in place concerning the minor child. You should speak with a lawyer about your specific situation to make sure you are not running afoul of any laws.

If the father is paying child support and has visitation rights pursuant to a court order, you need his consent which I would get in writing or you need the court to approve the move.
