Retain an attorney to file a contempt for the support arrears as the statute will require he pay for the attorney's fees to do so, and ask the court for permission to move out of state which should be granted if you can show the move is in the best interest of the child. Good Luck!

Given the facts you state, and assuming that your 17-year-old wants to move with you, I would say that the chances your move will be blocked are minimal. you should go to Court yourself to affirmatively SEEK permission and resolve it.

You might want to meet with an attorney regarding the particulars of your situation before leaving the state with your children.

But generally speaking, if there has never been an order regarding custody, support, and visitation, you should be free to move. Moving without the permission of a parent or the court, where required, can result in serious consequences.

Re: Moving child out of state

As long as you have a good reason for moving, the court will most likely allow you to move. As to the back Child support, I assume you have an MDOR order, You can also seek a contempt for non-payment of child support.

Good Luck.
