Moving Out-of-State

I plan on moving out-of-state withing the next couple of months. I've read in previous responses, that I need to get the courts permission, because the father has visitation and he won't agree to the move. Now EXACTLY how do I go about this? What exact paperwork needs to get done and everything like that. Also how long does the process normally take?

If there is already a court judgment (a "final" order) in effect, you need to file a Complaint for Modification. If the case is still on "temporary orders," you need to file a Motion for Permission to Remove Child to ___________________ (State).

In essence you need the court's approval, if the father refuses such permission. The process may take more than a couple of months.

You have to show the court the benefits of moving and over come the issue of harm to the father-child relationship.
