After a separation or divorce in Massachusetts would I be able to move with my parents who live in Minnesota? The purpose, I can not afford to live on my own in MA.

Re: Moving out of State

If you have children you need the court's permission or your ex-husband's permission to move your children out of state. However. the court will recognize a real advantage to your mocing out of state.

You do not need anyone's permission to move out of state if there are no children involved.

I presume that the divorce involves children.

If so, you need court permission or that of your ex-husband. However, the court is usually very liberal in granting that permission, based on the "real advantage" standard. You would need to be prepared to offer alternate visitation terms consistent with the age and maturity of the children.

I would be happy to consult further.
