Legal Question in Family Law in Massachusetts

Too many last names....

Hi there.

I have a brief question.

I am 7 months pregnant, and I have an issue with the last name my baby will take. I am currently with the baby's father and have been for 8 years, however, we are not marrried. My last name is obviously different than his, but the added factor is that he wants to change his last name back to his biological fathers name. The problem is, he's taking too long to acomplish this. When the baby comes, i dont want to have to give him one name and change it to another down the road, my question is, if I just give the baby my last name, will it cause me problems in the future,if any seperation should arise , meaning child support issues, etc.? If he signs the birth certifiacte as the father...Can the baby still have my last name?

I guess, I have another quick question if you could, Is there ''common law marriage'' in MA?

As to your second question of common law marriage in Massachusetts, it is not recognized as to Mass; however, if you were in a state that is was recognized and then came to Mass, Mass may recognize it, certain factors are considered!

It would not matter whose last name the child takes on the birth certificate in regards to child support.
