Non custodial parent has had child for 5 months at father's request

Father was granted a temp order for physical custody and shared legal custody via mediation in May. At the end of June, father asked me to take son in my home because he had been evicted and had no where to go. It is now mid nov and my son is still here. The original order also stipulated father provide counseling for child. I have done that, since he didnt. I have had 100% care and support of my son for the last 5 months. Can I go to court and ask for a modification to the original order? My son is in school in the city I live in, and his counseling sessions are here as well. He also has a med disorder that has recently been dx'd and I have been providing dr visits and support for this as well.

If the child is living with the non-custodial parent go to court and modify the judgment.
