Legal Question in Family Law in Massachusetts
non custodial parent eviction
When I applied for low income housing I had custody of my children. After waiting for over a year for an apt. my husband took my children an gained custody which I am still fighting for however I do have visitation. In the mean time I moved into my apt with full intentions on gaining custody back of my children.I am now being evicted because I do not have custody if I don't have an apt to bring my kids to visit for weekends I will not be able to visit my children.I am single and have little money so finding a place and paying full rent is not an option.I have all intentions of getting custody of my children back please help I only get to see them on weekends they stay overnight and without my apt I will not get to see them at all ! For the visitation it states I must have an apt. phone and a car.

Re: non custodial parent eviction
The rules for housing are based on the needs of "full-time" custody. If you have lost custody, the housing authority must apply its rules. The hope of regaining custody is insufficient.
