Can a parent take the children out of state when there has been no custody determined?

N aIf no action for custody has been filed in court, then, yes, a parent can take a child out of state. If an action for custody or divorce has been filed then a parent needs permission from the other parent or a judge to remove a child from massachusets.

Depends, Were the parents married when the child was concived-are both parents listed on the birth cert-in Mass an umarried mother has full custody rights unless there is a court order or action pending.
