Legal Question in Family Law in Massachusetts
How do I get my paretal rights back?
I gave my son up for adoption 3 years ago. His dad didn't so when we went to court it was easier for him to get custody. I was suppose to get my parental rights back but we do not get along anymore so we cannot use the same lawyer that represented us in the Adoption case. I share my son with his father now. All I want is my parental rights back and i'm sick of waiting for him.

Your question is a bit confusing. You state that you gave your son up for adoption. If this was a true adoption proceding then your parental rights were terminated. It is very difficult to have the Court overturn a true adoption. Thus the confusion why were you still seeing your son if this was a true adoption. I would strongly urge that you have an attorney review what papers were filled in your case and give you appropriate advice based on the Court record.

If you had contact with the son and if there was at least some verbal agreement, then these facts should help. It's my experience, that the Court usually bends over to attempt to reunite children with the parents, unless there is evidence of unfitness, neglect or abuse. I would urge you to return to Court and seek visitation.
