Legal Question in Family Law in Massachusetts

Here is my past legal history concerning child custody:

*Temporary restraining order verse husband granted children turned over to my custody

*Extension of order granted, evaluation with the family law clinic scheduled

*Child support hearing scheduled

It is the last matter that I am concerned about. I have this hearing in only a few days. What I would like to know is mainly what to expect. What questions is the judge likely to ask? What paper work should I bring into court with me? Should I file any paperwork ahead of time with the court?

Hello,

In order to evaluate the amount of child support one should receive the incomes of both Parties must be taken into consideration. A financial statement from both you and your husband will have to be filled out and you will have to meet with probation prior to going before a judge. You will want to see his financial statement to see how accurate it is, this is very important since the support is significantly based on his income, and you will also want to see proof of the income he claims he is making.

I would suggest prior to moving forward with anything you retain/speak with an attorney. Once an order/judgment is entered into, in order to change it in the future you would have to show a change in circumstances. So it is important to get it right the first time.
