Legal Question in Family Law in Massachusetts

Do i have to pay for braces if i don't have the money?

My ex wife and I have been divorced for over 11 years now and out 12 year old daughter wants to get braces. All major medical expences are split down the middle, but I don't have any money to help pay for these braces. Am I required by law to pay for a portion of them or no? To me braces are not a medical necessity and I feel as though I shouldn't have to put my new family into even more debt. My girlfriend and I have a 4 year old and another baby due in october. The braces are scheduled to be put on in august. Thank you for your help.

Your first family comes first. Braces are generally considered more than a cosmetic treatment. Unless these braces are truly and entirely unnecessary, you will be court-ordered to pay a share.

The length of time you have been divorced has nothing to do with it. Your child is your obligation until she is emancipated. At 12, she is probably not emancipated.
