Legal Question in Family Law in Massachusetts
Best way to pay
I live in CT w/ MA child visitation order. I make too much to qualify for legal aid, but I dont have enough on hand to retain an attorney. I need to make modifications to our current order but I can not do it alone. I can afford $300 a week, why is it so hard to gt an attorney to agree to this? Also, because it is a matter of contempt w/ the other parent, could they be hed responsible for my attorney fees? Not seeing my son is torture. HELP please!

If your ex is in contempt you could ask the judge to award attorney fees. However that is not a guarantee that you will recieve them.
I would be happy to talk to you regarding this matter.
Re: Best way to pay
I agree that you should seek attorney's fees, but that does not mean the court will award fees. Your suggestion for a payment plan does not seem unreasonable. There are many attorneys willing to accept nontraditional payment plans if a review of the circumstances justifies such. Feel free to call if you have any questions about this.
Re: Best way to pay
Depending upon how serious the contempt is and who the judge is you may be able to convince the judge to assess attorney's fees.
In any event, your proffered $300 weekly payment plan does mot sound unreasonable.
