Legal Question in Family Law in Massachusetts

Paying For College

My ex and I have an agreement (judgement filed in court) from 2 1/2 years ago that I would pay a percentage of college expenses and my ex would pay a certain percentage. Things went on as agreed for over 2 years. Now my ex has filed to have me pay a higher percentage. The agreement states ''this agreement is in effect as long as child is attending this state school. A modification can be filed if child attends a more expensive college.'' Will that stand up in court or will the judge likely make me pay more. I also cover medical insurance which costs over 1K a month. My income has only increased approximately $8,000 since we signed the agreement. My insurance costs went from $30.00 a month to over $1,000 a month. What is your opinion??

Change in Paying For College

Any party can file for a modification for a material change of circumstances or the deal with a clause such as the one you describe.

A judge's determination on the validity of the claim, and any changes that are to be made is purely speculation, especially since not enough facts have been provided.
