paying for private school

my ex husband has custody of my sons. he wants me to pay for private high school. Do i have to do that?

I think I have a different view.

Some of this depends on if the children have been attending private school before, and if they have not, is there a reasonable basis for this change.

Your ex would have to petition the court and prove to the court that the move of the children to such a school has merit. And even then, any contribution that a judge could order would be based on income and resources.

The usual rule for child support in Massachusetts is "Guidelines." Private high school can be ordered, but your income and/or the children's needs would have to make this reasonable. The Courts generally prefer to see funds saved up for college. Again, you PARTICULAR situation (children's needs and aptitudes, available income) will drive the determination.
