Legal Question in Family Law in Massachusetts

CS payments overdue

I owe nearly 20,000 in arrears for CS. My current order is $1000/month. That was ordered a few months ago when I didn't have a job. They based it on an earning potential of 40,000 (I have a BA and MA). Now I have a job as a sales associate and only earn 25K per year...can I have the CS lowered because I now actually have a job, but it really pays lower than the figure that was used in court???

Is there any way to remove CS - If I owe 20K based on earning 40K per year but I am only earning 25K, can they adjust the arrears or do they stick no matter what my circumstances are?

Re: CS payments overdue

You should retain an attorney to file a modification ASAP. Unfortunately the modification can only be prospective from the date of filing and service and not retroactive.
