Legal Question in Family Law in Massachusetts

pick up

If a mother has sole legal custody can she dictate who may pick up the children on my visitation days? I would like my fiance to be allowed to pick them up from day care and she removes her name every time i put it on.

Re: pick up

The mother has this right, especially if she has sole legal custody. You have no right to mandate this of her, absent a Court determination. You may believe that this is vindictive, and may be right. On the other hand, the mother may correctly believe that the fiancee is not suitable, even if she is not a direct "threat" to the children.

You and mother need to start working things out. Counseling or mediation is preferable. Court may be necessaty.

If I understand your question, and there seem to be some information missing, the person with the sole legal custody makes the rules. Whose children are you talking about?
