Legal Question in Family Law in Massachusetts

plaintiff failure to appear at pre-trial

My ex-husband is seeking custody and child support of my 17 1/2 year old son. His son is asking him to drop case. Reluctantly he has agreed to but will not go to the court to file the necessary stipulation of dismissal. He says he is just not going to show up.

What will the courts do if I show and he does not?

It will probably be dismissed, but a judge might continue it and send your ex a notice to appear. Then it would be dismissed at the next hearing date.

The same thing will happen if neither of you shows up, but if he shows up and you don't, it will be allowed.
