Legal Question in Family Law in Massachusetts
I have a pre-nup with my second marriage. How strong is that upon my death? States he is not entitled to my assets. I have children from previous marriage.

If the pre-nup was properly executed, it should be upheld.
If you have questions, I would suggest you consult with an attorney. If you like please feel free to contact me.
Thank you for your question.
Depending upon the wording of your prenuptial agreement, it should make some provision for the termination of the marriage as the result of the death of a party. That being said, if you have concerns or questions, I would make an appointment with an attorney - perhaps one that practices in estate planning. You want to make sure that your wishes are properly expressed. Our office prepares prenuptial agreements and estate plans, and would be happy to meet with you.
