Legal Question in Family Law in Massachusetts
We are preparing divorcing. I just signed a separation agreement at notory, but now I change my mind. What I should do?
I wanted to have sole costody of my child, my wife said I could have it, but she would not pay any child support, I agreed. She makes more money than I do.
Thank you for answering.

The agreement needs to be approved by the judge before the divorce is completed-at the hearing advise the judge that you dont agree with the terms and want to change them or speak with your wife and change them before the hearing by filing an amended agreement.
I agree with the previous attorney, except that I would not wait until you are in front of the judge to change the terms. You do not want to be making decisions under pressure, and you do not want your separation agreement to have handwriting all over it which could be confusing and cause disputes down the road.
I would hire an attorney immediately to review the agreement and make changes. The small investment of hiring a lawyer will be repaid many times over if you have a good agreement that treats you fairly. Please feel free to contact my office if you would like to speak to an attorney.
Retain an attorney to redraft and resubmit another agreement as most judges will not allow you to agree to no child support as the child support guidelines must be followed. Good Luck!
