Legal Question in Family Law in Massachusetts

Pretrial memo

I'm going to a pretrial for a modification in a couple of weeks and have a question.

What happens if one side does not provide the court with a pretrial memo (but the other side does)?

You absolutely should draft one, as should the other side. If you need a model, you can ask for one at the local law library. If you are representing yourself, the judge may demand that you do one in court.

The Court reads what it gets. Sanctions can be set for a party that does not file, but pro se parties (those without attorneys) are often allowed to "slide" on this.
