Legal Question in Family Law in Massachusetts

I am in the process of filing for a divorce from my husband of twenty years. Unfortunately I had to make this decision due to many year of infidelity and substance abuse. We've shared our two family home during this time of which he inherited from his gradmother. Do I have any legal rights to the home? His name is the only one on the deed/mortgage. I no longer reside there however I still occupy one of the apartment for my daycare and he lives in the other.

Due to the length of the marriage the court will most likely find that all property in either of your names individually is martial property subject to equitable division. You can contact my office at 617-410-6467 to discuss your options.

Thank you for your question.

Given the length of your marriage, I strongly advise that you retain counsel to represent you. In Massachusetts, all property of the parties, whenever and however acquired, is considered to be marital property. Marital property is divided equitably, or fairly, given a number of factors and considerations which are personal to your marriage.

Feel free to give our office a call if you would like to discuss retaining an attorney to represent you in obtaining a fair settlement of your marital estate. 617-357-4898
