Legal Question in Family Law in Massachusetts

Is this proper?

Hi,

My soon-to-be-ex submitted 2000 of financial discovery documents to his attorney. His attorney is demanding that the documents stay in his (the attorney) office and that only my attorney will be permitted to review and copy the documents.

Is this proper? Can a court compel them to just hand them over to us?

I'm asking because I want a second opinion.

Your ex's attorney must make the documents available to be reviewed and copied. The rules do not require that he or she make the copies at his time or expense. He or she can maintain appropriate control over the documents. Your attorney should suggest that the copies be brought to a local shop and copied at your expense.

Yes, this can be deemed proper. Your attorney could request that the items be copied on to a disk and indexed.

Unless there is a protective order, you are entitled to see copies of the documents. Any opinion to the contrary is wrong.
