Legal Question in Family Law in Massachusetts

property settlement agreement

In the not contested divorce , what happens if the judge does not approve the property settlement agreement between two parties for reason of ''un-fairness'' (parties do not have any children)? Does this means that divorce is not final and parties have to draw a new agreement or the judge modifies the agreement and this modification is final and bounds both parties by law to abide by it?

Re: property settlement agreement

The Judge could suggest the parties renegotiate the agreement in those areas he considers unfair, or he could simply mark the case for trial. One or both parties should have an attorney to keep things from getting out of hand.
