Quadro order

I was divorced in 1999 and my then spouse did not file a QUARDO at that time for 1/2 my profit sharing. However, I just received one. Is he entitled 9 years later?

If it was part of the original divorce order then yes they are entitled to it now. The terms of the division of the assets remain the same. It is usually a certain percentage from date of marriage to date of divorce. You should contact an attorney to review the original divorce paperwork to insure that the money they are seeking is actually what they are entitled to. You may have a defense to giving the money under the QDRO but generally you must give it to them.

If it was part of the court order at the time of divorce, yes. However, you need to contact your original attorney and determine how his interest is defined so as to see how his precentage is treated with respect to any new cotnributions by you or your employer.
