Question about nondisclosure of assets

Hi,

My exhusband has hidden money. I have provided my attorney with evidence to show this including:

1. documentation showing he sending mail to aother address

2. Letters from Fidelity that had his sisters address on them

3. No record, documentation from his account he turned over for discovery, of where 30,000 in cashed in IRAS went.

My lawyer wants to wait to sell our house to file for this

Non disclosure of assets. I am worried he will move the money again from his name and SS#.

Can I go to a judge and get a supeona for any financials under his SS# and for depositions for people I know he used to help him and past girlfriends he had affairs with during marriage?

Please help me....

Also, can I get a motion to ammend retracted by providing documentation that demonstrates my exhusband violated the terms of the agreement?

I a quite distressed as my ex getting away with SO MUCH!

Your concerns seem legitimate.

Your lawyer can move and seek a court order specifically restraining your ex from disposing or otherwise making the money magically move. In fact, you can even seek an ex-parte order: an order without the other side knowing about your initial request. Then the court will have a second hearing with notice.

If you are represented by counsel, you should talk to your lawyer to find out the reasoning for waiting. If you are represented by counsel, usually you cannot go in and file a request without advising your attorney or involving your attorney.

If this concern suggests that you are losing confidence in your attorney, it may be time to re-evaluate your attorney-client relationship.
