Reduced and Late Child Support and Moving Out of State

My ex is late with child support, sometimes up to several weeks. Can anything be done? In addition my ex had the amount of child support reduced because of unemployment but is now working again but will not admit it. What can I do? I am thinking about moving out of state for the benefit of my child, my ex is not consistant with any visits or contacts with our child. What are my rights as to moving and how should I proceed?

Hi -

To help w/ your ex's late child support why not ask the court for what's called a "wage assignment," that way the child support will be deducted automatically from his (or her) pay.

As for moving out of state - are we talking Connecticut or the West Coast - to some degree it depends where you want to take the child.

All these issues may be addressed by filing a Complaint for Modification in which you could ask for a wage assignment to have support paid directly from employer, perhaps through the MA Dept. of Revenue, who can monitor employment. You could also request court revisit visitation and the right to move out of state. Good Luck!
