Legal Question in Family Law in Massachusetts

If someone has been in rehab 2 times, the first without a child but court ordered the second time they have a child but self checked in and completed all the recommendations from the staff on programs. can a family memeber who watched the child get temp custody based on the childs well being is in imminent danger? When the individual checked into rehab the second time the family member watched the baby without the mother giving up any rights what so ever.
