Legal Question in Family Law in Massachusetts

Re-marriage

I'll get getting remarried to a divorced woman with 2 kids, and I have 2 kids of my own. What exactly will a prenup do for us and what terms would be typical?

Re: Re-marriage

A pre-nup is an agreement that the parties enter into in order to protect their respective estates. So if one of you dies, the suriving spouse is limited in their claims against the other.

It also protects each of you in terms of your respective estates in terms of a divorce. So if one of you moves into the others home, the pre-nup might prohibit the other spouse from claiming an interest in the home as it was the marital home.

If you do have a pre-nup prepared, you each need to have independent counsel.

It would deal with issues such as property division and alimony at a minimum.
