Legal Question in Family Law in Massachusetts

Repayment from State for money taken by non-custodial parent taxes....

After my child support order went into effect(1987), my ex had another child whose mother was on welfare. I was supposed to get any tax return money he was due and had a wage assignment also. I received nothing for years (15). I recently found out that the State was taking his taxes to repay this childs mother being on welfare while leaving my chidren with no support. They are since grown and I am still waiting to get the arrears paid back from him. My question is how do I go about recapturing those taxes that were due to me first, not the State of Massachusetts, as my order preceeded this other child's birth and therefore my children were entitled to any taxes first Before the repayment of any welfare benifits this child used. My children and I were not on welfare.Any help or direction to turn would be very appreciated!!

Retain an attorney to file a Complaint for contempt for the arrears. Good Luck!

Your major recourse is to file an action in contempt for all the items that you believe he was suppose to do or all the money that was due, that he failed to do or remit.
