Child support and visitation are unrelated to each other. You have a right to receive child support and he has the right to seek visitation. The standard for visitation is the best interests of the child. Of course, child safety is very important. However, having committed a sex crime doesn't necessarily mean that he will victimize his son. It is likely to be very difficult for him to receive unsupervised visitation. The terms of his probation may prohibit contact with children. Assuming that he can seek visitation, he must go to probate court to get visitation rights and you will have the right to object and have a judge determine visitation rights. Unless your son has been victimized by him, it is likely that supervised visitation will occur at some point.
