Legal Question in Family Law in Massachusetts

Rights of Grandparents

What are the rights of grandparents in a nasty divorce where the husband has been mentally and physically abusive the the mother. We are the grandparents of the mother's side and the husband is fighting my daughter's efforts to gain full custody of two children. We are thinking of filing suit based on our rights as grandparents.

Re: Rights of Grandparents

Your grandparent's rights are likely to be applicable only if both parties are refusing you visitation. Even then, there are limits. Your best course is not to "mix it up" with your daughter, but to support her in every way possible, especially financially. She needs a good legal fight, without undue distractions. Make sure that she and her lawyer have all of the information and financial assistance you can provide. The courts dislike unnecessary three-ring circuses.

Re: Rights of Grandparents

You have the right to seek visitation of your grandchildren. The best you can probably do for your daughter and yourself is to make sure she has good legal counsel. You can sue for visitation is need be.
