Legal Question in Family Law in Massachusetts
I have run a business out of my home for the last 20 years but am looking to become employed outside the home. Am I more likely to be able to stay in the home in the event of a divorce if I keep my business active and do not seek employment outside the home....I currently have benefits through my spouse and am also not sure how that would carry over...Thanks

You may get some consideration if there is something unique or special about your home office environment. That being said, it may make no difference at all, especially if it can be argued that you have the ability to engage in employment regardless of where you live. If you mean health insurance, the court can order that you remain on your spouse's health plan. The court can make you pay for the difference in cost to your spouse, or they may not.
