Separation agreement

I'm currently separated from my husband for about 2 yrs. We share a 2 family house, he is the only one on the mortgage and I'm on the deed along with him. The problem is that he comes and goes as he pleases and its not fair to me. He doesn't spend any time with our two sons and he has a woman calling me at the house. He has no respect for me and this is all taking a toll on my health. He also doesn't pay the mortgage on time and I've had to negotiate with the mortgage co. regarding foreclosure. I need some place stable for me and the kids where I'm not scared of losing our home. I need to know if here is any legal way that I can put him out of the house. He doesn't live here but ALL of his clothes are here and he takes showers here. He spends his money on his car, women and clothes and not the mortgage to make sure his family is secure.

You can file for divorce is you so wish.

If not, you can for for Separate Support while some other action is pending. You can also file a request to the court ask them to order your husband to vacate the home.

You should retain an attorney to file a complaint either for Divorce or Separate Support and request he be ordered to vacate. Good Luck!
