If you are going through a separation, can you take your child out of the state on a vacation?

In Massachusetts, at least, separation is not really a legal status. If there has been a divorce action filed, or if the parties are negotiating or mediating their uncontested divorce, then I would be careful about removing a child from the state for more than a brief visit without the permission of the other parent. Once a divorce action has been filed or once a paternity action has been filed, you need permission from the other parent or a Judge before you "remove" a child from Massachusetts. In all my years, I have never found out exactly what removal means. I don't know if removal means permanently taking the child out of the state or temporarily. To be safe, I suggest you get permission before taking the child out of state for any reason.
