Legal Question in Family Law in Massachusetts

Serrvice of Complaint for Contempt

I have a temporary order for child support. My husband has not paid in months and he lives in a foreign country. I filed a Complaint for Contempt. Can I have the constable serve his divorce lawyer here? If I have to serve him in the other country it will cost more than he owes.

You may have to seek a special order. This will require a motion before the judge. I have had some recent experience with this; the judge has to be flexible and the situation set out. Certainty of notice is the key.

The cost of service will be part of any judgment, but you will have to pay it in advance. THis, it makes sense to limit the costs.
