Legal Question in Family Law in Massachusetts

Serving a capias warrant

If DOR/CSE serves a capias warrant

via County Sheriff is the subject/defendant billed for the service? What if the defendant lives outside of the issuing county?

Re: Serving a capias warrant

The subject to be detained is obligated to pay for his or her detention. A capias for arrest is effective anywhere in the Commonwealth, regardless of the location of the issuing court. Beware of hiding in North Adams from a capias issued on Martha's Vineyard; the sheriff or constable will want MORE money to bring you in due to distance and time factors (and the Court ---will--- award the higher fee).
