Legal Question in Family Law in Massachusetts

IN my settlement agreeement it states, "as long as exhusband is paying child support and making equal contributions to the children's college expenses, he and I will share any tax refunds and tax payments due proportionate to our incomes."

Can I fight this? If I remarry is my new husband supposed to share his refund with my exhusband if we file jointly? Can I go back to court to alter this?

Any issue regarding the children is modifiable. In order to be successful in a modification case, you must prove that there has been a substantial change in circumstances which renders the old judgment invalid.

If there is a change in your ex-husband's living or financial sitatuation, or your living or financial situation either one of you may file a complaint for modification.
