Legal Question in Family Law in Massachusetts

I have shared custody of my 9 year old. My child stays with me part of the week, and with the mother and her husband the other part of the week. The husband is a piece of work. The husband told me he married my ex to get his hands on the child support money. He's a thief, a manipulator, a liar, and a bully. He has told me I'm not allowed on his property to pick up my child, he has tried to extort money from me using my child living in his house as a weapon, he has threatened me physically. My child does not want to be returned after my visitation unless he's absolutely certain his mother is at the property. Long story short, I don't want my child living with this guy, learning to be a liar, a thief, a bully, a manipulator. I think I would be within my rights as a parent to demand my child not be around this guy. He's bad news, and I don't want my child under his influence. Can I file a motion to have a judge order this guy out of my child's life?

You can file a complaint for modification and a motion for temporary orders requesting sole physical custody and addressing the issue of the child's presence around mother's boyfriend. However, if there are no issues with mother's caretaking, you would have to make a strong showing that this behavior is detrimental to the child for any change in custody to be ordered.
