Shared Legal Guardianship with Mother

I have been taking care of my ex-girlfriend's son for several years while she has been in ongoing treatment for health issues. (We also had a son together who also lives with me). She takes care of her son and our son about 10 hours a week. Her child's biological father is not involved and she has no other relatives. Can my ex-girlfriend consent to sharing legal guardianship of her son with me? She will not consent to giving me guardianship by myself.

You will need the consent of the Biological Father and with that the court may permit same.

Yes, she can do this. The biological father will also have to be notified to allow him to object or assent.
