Legal Question in Family Law in Massachusetts

Very Sick For Visitation

If the child has a fever, strep, diarrhea does he have to get out of bed and go on visitations for that one day? Visitation would be taking him to a party of an 18 year old and the child is 11 and sick.

Common sense in this situation dictates that the child probably should not get out of bed and should instead concentrate on getting well.

The court and the law is not designed to micro-manage families. That being said, these minor changes in visitation schedules must be worked out between the parents. You must have an open and honest channel of communication with the other parent otherwise, you'll be putting your child in the middle of every minor problem you encounter until the child turns 18.

In this case, you would likely have a substantial defense to a contempt action, provided the illness was real.
